WHAT IS SMALL ESTATE ADMINISTRATION?
When the decedent's probate estate does not amount to more than $75,000 in personal property (less encumbrances, liens, etc.), and it does not amount to more than $100,000 in real property (less encumbrances, liens, etc.), then a small-estate affidavit can be filed to administer the small estate. The only catch with this approach is that you have to wait six months before you can file the small estate affidavit; whereas, if you are filing an informal probate, this process can take in total six months as long as there are no disputes.
